California Separates Marijuana and Alcohol Consumption

California regulators separate cannabis from alcohol

The memo was released by the California Department of Alcoholic Beverage Control (ABC). This memo was released back on July 25th on the Cannabis Portal website. It answers the frequently asked questions that are received by the ABC.

Dual Licenses Get the Green Light

A frequently asked question is whether individuals are allowed to hold both a license to sell alcohol and a license to sell, grow, and process cannabis. The ABC has clarified that neither the Medicinal and Adult-Use Cannabis Regulation or the Alcoholic Beverage Control Act state that holding both licenses is prohibited.

However, holding two licenses is all that is allowed under both rules. Combining alcohol and cannabis businesses is prohibited.

California Regulators Separate Cannabis from Alcohol

Under these regulations, cannabis and alcohol licenses cannot be combined, and they must be run at completely separate locations. People wanting to consume a beer and a blunt at a bar are out of luck.

"The MAUCRSA (Business and Professions Code section 26054) states that the holder of a license issued under the MAUCRSA 'shall not sell alcoholic beverages or tobacco products on or at any premises licensed under this division,'" the notice states.

Those that purchase recreational cannabis or even hold a medicinal card are not permitted to consume weed in bars either. Public consumption of any cannabis products is strictly prohibited by the California state law. Since any premise with a license to sell alcohol is technically public, marijuana consumption would be illegal in any location selling alcohol.

This restriction applies at all times and even goes into private-public functions. Cannabis can only be consumed in a private residence where it does not impede on the public.

According to the California state laws as well, both manufacturers and retailers are not allowed to mix alcoholic beverages with cannabis products.
