Federal Court Ruling Opens Way For Cannabis Interstate Commerce; Costa Rica About To Legalize Marijuana, Michigan Breaks Cannabis Sales Record

Maine Court Ruling paves the way for Interstate Commerce

According to Marijuana Moment, a federal appeal court verdict in Maine may pave the way for interstate cannabis sales. The US Court of Appeals for the First Circuit ruled 2-1 that Maine's legislation preventing non-residents from owning medicinal cannabis enterprises violates the US Constitution. Based on the Commerce Clause of the United States Constitution, the court's decision was made public on Wednesday.

The Maine Medical Use of Marijuana Act states that "all [the] executives or directors of a [cannabis dispensary] must be Maine residents." However, the Dormant Trade Clause of the Constitution grants Congress "[the] [p]ower... [t]o regulate Commerce... among the several States," while prohibiting states from implementing legislation that might impede interstate commerce. The court determined that the "dormant implication of the Commerce Clause" prevents Maine's residency requirement from having legal effect.

Costa Rica's President Says Rec Cannabis Bill Will Soon Reach Congress

Former President Carlos Alvarado Quesada signed a measure already enacted by Congress to legalize marijuana in Costa Rica in March. While Quesada's opinion on medicinal marijuana remained unknown, given his early resistance to portions of the legalization bill, newly elected President Rodrigo Chaves is prepared to accept its recreational use. During the anniversary of his administration's first 100 days, Chaves stated that an effort to legalize adult use of cannabis would be brought to Congress for approval, according to Tico Times.

 He also stated that the medicinal cannabis regulation would be issued soon.

"We have prepared the regulation of industrial hemp for therapeutic use, and we will advocate the law to legalize marijuana for recreational use," President Chaves added.

Michigan Hits Another Monthly Cannabis Sales Record

The state's Marijuana Regulatory Agency revealed that recreational cannabis sales in Michigan exceeded $149 million in July, setting a monthly record. Recreational cannabis purchases reached $188,818,744, while Michigan residents paid $21,121,711 on medicinal cannabis.

The Agency also revealed that flower was the best-selling product category in July, with 46,777 pounds of recreational marijuana sales for around $91 million, followed by vape cartridges and sweets. Furthermore, according to the data, farmers killed 159,226 and harvested 188,252 plants out of 1.34 million active plants in July.
