Curaleaf Hit With Another Class-Action Lawsuit Over Mislabeled THC

The legal battle of the cannabis company, Curaleaf Holdings, Inc. (CSE: CURA) (OTCQX: CURLF) continues after another lawsuit was filed against the company. The cannabis powerhouse faces a lawsuit for allegedly engaging in unlawful trade practices, gross negligence, and utter lack of appropriate and adequate safety protocols with its manufactured, bottled, labeled, shipped, and sold products.

The lawsuit against Curaleaf has been going on for some time now after the Massachusetts-based company mislabeled THC and CBD drops. This new federal lawsuit was filed on Monday in the U.S District Court in Portland, Oregon, by a 77-year-old man. Oregon Live reported that the 13-page document asks for class-action status and $200 each for the several hundred customers who bought CBD wellness drops in Oregon over the past year. The products which necessitated this court action contained high doses of a psychoactive ingredient.

The mistake made by Select, the Oregon cannabis brand owned by Curaleaf last year, could lead to serious health implications. In error, Cura Cannabis mixed up two of its product lines: CBD and THC. Oregon regulators recalled the brand’s 1,000mg unflavored Select CBD drops, labeled as “Broad Spectrum” which contained THC. The brand’s 1,000mg bottles of unflavored Select THC Tincture however, did not contain THC.

The Oregon Liquor and Cannabis Commission confirmed this mix-up. It explained that the mix-up was the reason people were getting high after using CBD products made of hemp and that the oversight happened at the company’s production site in Portland. Following the error that was made last year, Curaleaf announced, “After our preliminary investigation, we believe that this mistake occurred due to unintended human error.” The company added that it would work on improving its quality control and focus more on the training of its production workers.

Oregon regulators proposed a 70-day suspension and a $200,000 fine for Curaleaf. So far, the company has settled ten lawsuits filed by Michael Fuller, the Portland attorney representing the affected customers. In a separate litigation, Fuller is seeking compensation for everyone who purchased the mislabeled CBD products.
